Who we are
Hosobi (hosobi.com) lets creators turn YouTube and Vimeo videos into TV-style channels that run 24/7, with a
program guide. It is run by Good Vibrations Media LLC ("we" or "us"). These terms are an agreement between you
and Good Vibrations Media LLC. By using Hosobi, you agree to them. If you don't agree, please don't use Hosobi.
Age
- To watch, you must be at least 13. If you're under 18, you may watch only with a parent's or
guardian's permission, and they agree to these terms for you.
- To make a channel or connect a Vimeo account, you must be at least 18.
Your account
- Give us accurate information, including an email address you can get mail at.
- Keep your password safe and don't share your account. You're responsible for what happens on it. If you think
someone else has used it, email hello@hosobi.com right away.
- Viewers don't need an account to watch.
Rules for everyone
- Follow the law, and don't use Hosobi in a way that is deceptive, false or misleading.
- Don't infringe or violate anyone's rights, including copyright, trademark, privacy and the right to control
the use of their name or likeness.
- Don't try to break, overload or get around Hosobi's limits or security, and don't copy Hosobi's data in bulk
with automated tools.
- Don't pretend to be someone else, or to be Hosobi, YouTube or Vimeo.
- YouTube's terms let you watch YouTube videos for personal, non-commercial use only, and they give public
screening as an example of what's not allowed. So don't show a Hosobi channel of YouTube videos on a public
screen, such as in a shop, bar or café.
Your channel and videos
You need the rights. Only add videos you have the right to show, and only use a channel name,
description or logo you have the right to use. Nothing illegal or infringing, and nothing that breaks YouTube's
or Vimeo's own rules.
You keep ownership. We don't claim ownership of what you add. You give Good Vibrations Media LLC permission to show
it on your channel and wherever your channel appears (your guide, On Demand, share pictures and embeds on other
websites), and to store and copy it as needed to run Hosobi. This permission is worldwide and free of charge, and
it ends when you remove the item or delete your account. Once your channel is live, anyone can watch it. On a
paid plan, other networks on Hosobi that enter your network's or channel's address can also carry your live
channel in their guides and embeds. That's on for every channel until you turn it off (a switch in its editor on the Channels
page).
Keep YouTube videos free to watch. Don't charge people to watch a channel that has YouTube
videos, and don't put it behind a paywall, a required subscription or anything other than pressing play. Don't
sell ads, sponsorships or promotions on or inside the player, or on a page where your channel is the main
attraction.
Children. Don't make a channel aimed at children under 13 without asking us first.
Your link (paid plans). You're responsible for where your custom link goes and what it says.
It may point to your own site, a donation page or similar, but never to anything illegal, sexually explicit,
deceptive or harmful, to malware, or to a scam. Don't present it as an ad or sponsorship. We may remove a link
that breaks these terms.
We don't review every video, and we may remove a video or channel that we believe breaks these terms, the law,
or YouTube's or Vimeo's terms.
YouTube and Vimeo
Hosobi uses YouTube API Services to show YouTube videos. By using Hosobi, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). How Google handles your information is
covered by the Google Privacy Policy.
When you add, watch or embed Vimeo videos on Hosobi, you also agree to follow the Vimeo Terms of Service.
Hosobi isn't affiliated with, sponsored by or endorsed by YouTube, Google or Vimeo. YouTube videos play in
YouTube's own player. Vimeo videos play in Vimeo's player or, on some phones and tablets, stream from Vimeo into
Hosobi's own player. YouTube and Vimeo decide which videos are available. If you connect your Vimeo account, you
can disconnect it at any time in your settings.
Embedding a Hosobi channel on your site
You can show a Hosobi channel on your own website with the embed code from Share on your GM Dashboard. If you do:
- Keep it big enough. Keep it at least 320 × 260 pixels, the minimum our code sets, and don't
crop it.
- Don't cover it. Nothing over any part of the player: no pop-ups, banners, cookie bars, sticky
headers, frames or buttons.
- Keep it visible. Don't hide it, make it see-through, move it off screen, or use it to play sound
in the background.
- Leave it as it is. Don't change, script or block the player, don't put it inside another frame,
and don't make hovering over or tapping it do anything else, like opening a pop-up. Don't hide YouTube's or
Vimeo's logos, titles or links. Don't put another YouTube player that starts on its own on the same page.
- Don't charge people to watch it. No paywall or required subscription, and no ads or sponsorships
sold on or inside the player, or on a page where the channel is the main attraction.
- Mind where you put it. Not on a site with illegal, infringing or sexually explicit material.
If a site breaks these rules, we may take the channel off the air, which also stops it on every site that embeds
it. We may also change how embeds work, or stop offering them, at any time.
Paid plans
Paid plans aren't open yet. When they open, they're billed monthly and renew automatically each month until you
cancel. Before you pay for one, we'll show you the price, what's included, how billing and renewal work, and how
to cancel, and you'll need to be at least 18 and an adult where you live. Plan fees pay for Hosobi's own tools,
such as more channels and scheduling. They never pay for watching: viewers never pay to watch YouTube videos on
Hosobi.
YouTube and Vimeo can change their services, rules and players at any time, and we don't control them. If a
change like that affects how videos play on Hosobi while your plan's other features still work,
you're not entitled to a refund because of it, to the extent the law allows.
Copyright complaints
If you believe a video on a Hosobi channel infringes your copyright, email hello@hosobi.com with:
- your physical or electronic signature;
- the work you believe is being infringed;
- the channel address (like hosobi.com/channel-name) and the video's title or link, so we can find it;
- your name, mailing address, phone number and email;
- a statement that you believe in good faith that the use isn't authorized by you, your agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you're the
owner or are authorized to act for the owner.
We'll remove the video from the channel quickly and let the channel's owner know. If the video is on Vimeo, we'll
also forward your notice to Vimeo. Because the videos themselves are hosted by YouTube and Vimeo, you can also
report them there.
If your video was removed by mistake, you can send us a counter-notice with your signature; the
video and the channel it was on; a statement, under penalty of perjury, that you believe in good faith it was
removed by mistake or misidentification; your name, address and phone number; and a statement that you consent
to the jurisdiction of the federal court for your address (or, outside the US, any court where we may be found)
and will accept legal papers from the person who complained. We'll send a copy to that person and put the video
back in 10 to 14 business days, unless they tell us they've gone to court.
We end the accounts of people who repeatedly infringe others' copyrights.
Ending your account
You can stop using Hosobi at any time. To delete your account, email hello@hosobi.com from
the address on your account (see our Privacy Policy for what we delete).
We can suspend or end an account, or take down a channel, if it breaks these terms, the law, or YouTube's or
Vimeo's terms, or to protect viewers or Hosobi. We may also change or stop parts of Hosobi, including when YouTube
or Vimeo change or end what they offer.
Disclaimers
Hosobi is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind,
express or implied, including warranties of merchantability, fitness for a particular purpose and
non-infringement. We don't promise that Hosobi will always be available, uninterrupted or error-free, or that any
video will play.
Channels are made by their creators, and the videos come from YouTube and Vimeo. We don't control them and aren't
responsible for them.
Limits of liability
To the extent the law allows, Good Vibrations Media LLC won't be liable for any indirect, incidental, special,
consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about
Hosobi is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.
Some places don't allow these limits, so they may not all apply to you.
Claims caused by your use
If someone makes a claim against Good Vibrations Media LLC because of your channel, the videos you added, your
website's embed, or your breaking these terms or the law, you agree to cover our losses and reasonable costs from
that claim, including lawyers' fees.
Governing law
Pennsylvania law governs these terms and any dispute between you and us about Hosobi. Any such dispute will be
decided in the state or federal courts located in Pennsylvania, and you agree to their jurisdiction.
Changes to these terms
If we change these terms, we'll post the new version here with a new effective date. For important changes, we'll
also email account holders and put a notice on Hosobi's home page at least 30 days before the change takes
effect, unless the law, YouTube or Vimeo make us change sooner. If you keep using Hosobi after a change takes effect,
you accept the new terms.
